End User License Agreement — Ogneliss Dialer

Important: By installing, launching or using Ogneliss Dialer (hereinafter — the "Application"), you agree to the terms of this Agreement. If you do not agree with any of the terms, do not install or use the Application.

1. Subject of the Agreement

1.1. What is granted to you

The Rightsholder grants you a gratuitous, non-exclusive, non-transferable, revocable license to use the Application on devices you own for personal non-commercial purposes.

1.2. What is NOT transferred to you

The Application is licensed, not sold. This Agreement does not transfer ownership of the Application, its source code, graphics, name or other intellectual property to you.

The source code of the Application is closed and is a trade secret of the Rightsholder.

2. Permitted Actions

You have the right to:

install and use the Application on any number of devices in your lawful possession;
create backup copies of data created by you in the Application (notes, tags, block lists);
share a link to the Application page in the official app store with third parties.

3. Prohibited Actions

You are not entitled to:

Decompile, disassemble, deobfuscate the Application or otherwise attempt to obtain its source code, except for cases expressly permitted by applicable law and only within the limits allowed by it.

3.2.

Modify the Application, create derivative works based on it, embed its parts into other software.

3.3.

Distribute the Application through third-party app stores, file-sharing services and other channels, including distribution of modified versions.

3.4.

Use the Application or its parts for commercial purposes, including resale, rental, inclusion in paid products or services.

3.5.

Remove or alter copyright notices, the name of the Application and other designations of the Rightsholder.

3.6.

Use the name and graphic designations of the Application to promote your products or create the impression of a connection with the Rightsholder.

4. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS", WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

The Rightsholder does not warrant that:

the Application will operate uninterruptedly and without errors;
the Application is compatible with any device or operating system version;
call filtering functions will identify all unwanted calls or not block a wanted call;
data created in the Application will not be lost due to device failure, reinstallation or update.

Responsibility for backing up your data lies with you. The Application provides manual export — use it.

5. Limitation of Liability

To the maximum extent permitted by applicable law, the Rightsholder is not liable for:

missed, blocked or failed calls, including emergency ones;
direct or indirect damages, lost profits, data loss;
failures of the device, operating system or other software.

5.1. Emergency calls — separately

Do not rely on the Application when calling emergency services. Emergency call handling is performed by the operating system and the carrier. If in doubt, use the default phone application of your device.

Blocking functions do not apply to emergency numbers, however the Rightsholder cannot guarantee the correct operation of telephony on all devices and firmware.

6. Term and Termination

6.1.

The Agreement is valid from the moment of installation of the Application until its removal.

6.2.

The Rightsholder has the right at any time to cease support for the Application, stop its distribution or remove it from the app store without explanation and without compensation.

6.3.

Your rights under this Agreement terminate automatically upon violation of any of its terms.

6.4.

You have the right to terminate the Agreement at any time by deleting the Application from your device. Your created data is deleted along with it.

7. Confidentiality

The Application does not collect or transmit personal data. It does not have internet access permission, which can be verified in the properties of the installed application.

8. Changes to the Agreement

The Rightsholder has the right to change the terms of the Agreement. The new version comes into force from the moment it is included in the Application update.

In case of material changes, the Application will ask for consent again at first launch after the update. Continued use implies acceptance of the new version.

9. Applicable Law

This Agreement is governed by the laws of the Russian Federation, to the extent not contradicting the mandatory norms of your country of residence and the rules of the app store through which the Application is distributed.

If any provision of the Agreement is found invalid, the remaining provisions remain in force.
